GENERAL CONDITIONS OF SALE

1. Scope of application

These General Conditions of Sale regulate the contractual relationship of sale between Tertio and customers who place orders through the website www.nailshoping.com.

By placing an order on the Website, the Buyer expressly and irrevocably accepts these Terms and Conditions. These terms and conditions may be modified at any time, and only those in effect at the time the order is placed shall apply.

3. Product availability

The products offered on the Website are subject to availability. If a product becomes out of stock after the order has been placed, the Seller reserves the right to cancel the order or offer an alternative product with similar characteristics. The Buyer will be informed of any availability-related issues.

4. Prices

Product prices are indicated in euros (€) and include applicable Value Added Tax (VAT), unless otherwise indicated. Shipping costs, if applicable, will be clearly and separately indicated during the purchase process.

The Seller reserves the right to change prices at any time, without affecting already confirmed orders.

5. Purchasing process

The Buyer selects the desired products and adds them to the shopping cart.

The Buyer enters the shipping and billing information.

The Buyer selects the payment method and confirms the order.

The Seller will send an order confirmation by email, which will include a summary of the order, the Buyer's details, and the Terms and Conditions.

6. Payment methods

The Buyer may make payment using the following methods:

Bank transfer.

Cash on delivery

Other methods indicated on the Website.

The order will not be considered formalized until payment has been confirmed by the Seller.

7. Shipments

Delivery times and shipping costs will be indicated during the purchasing process. The Seller undertakes to ship within the indicated timeframe, except in cases of force majeure or circumstances beyond its control.

The Buyer is responsible for checking the condition of the package upon delivery. Any incidents (damage, errors, etc.) must be reported to the Seller within 24 hours of receipt.

8. Right of withdrawal

In accordance with European regulations, the Buyer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without providing any justification. To do so, they must notify the Seller in writing and return the product in perfect condition, with all its accessories and original packaging.

Return costs will be borne by the Buyer, unless the return is due to an error by the Seller.

9. Guarantees

The Seller guarantees that the products sold comply with applicable regulations and are free of manufacturing defects. In the event of a defect, the Buyer may request repair, replacement, or return of the product, in accordance with current legislation.

10. Responsibility

The Seller shall not be liable for:

Damage caused by improper use of the products.

Delays in delivery due to causes beyond its control (e.g. strikes, adverse weather conditions, etc.).

11. Data protection

The Buyer's personal data will be processed in accordance with the Website Privacy Policy, available at https://tertiomayorista.com/privacy-policy. The Seller undertakes to ensure the confidentiality and security of the data provided.

12. Applicable legislation and conflict resolution

These Terms and Conditions are governed by Spanish law. Any dispute arising from their interpretation or application shall be submitted to the competent courts of the Seller's domicile, unless otherwise provided by law.
